When i try to run the example suite on the engine without having the settings imported from the Morrowind.ini openmw quits with the error:

ERROR: Unknown fallback name: FontColor_color_header

We need a settings.ini file for the OpenMW Example Suite so it's possible to run it with zero dependancies on files from Morrowind, if we were to take a Morrowind.ini, remove all the stuff that isn't required, and change the values of the remaining entires to something else, would we then be able to re-distribute that or is it a problem because the remaining group and key names are the same as in the Morrowind.ini file?

Open your openmw.cfg. If it's empty or has just one line ( encoding=win1252 ), then remove the line, then open this link and paste this into file.

But yes, I agree, Example suite should work without user needing to configure it.

Zini said that at some point OpenMW will need to have 'defaults' so that morrowind.ini is no longer a requirement. It will come, just be patient.
