Even in vanilla MW, mercantile is broken and causes a difficulty inversion above a certain level. I know this because MCP has an option to "fix" it.

The engine could run the dialogue command in a sandbox and compare it to the previously-seen versions of it. Also, if it contains unique hyperlinks like joining a guild, or it contains inventory changes like taking or giving items, or anything funny like that, it wouldn't be grayed out, even if it's...

How wrong it behaves has nothing to do with wherever the algorithm came from. It's hard (as in strictly speaking) reverse engineering. It's not bullshit. It has its form for a reason, even if it's not right. The fact that it's wrong doesn't mean that we need to come up with anything that seems to be...

It's around 25% on 24 hours. It's less likely at 1 hour, but can still happen. Normally I'd be in favor of fixing obvious bugs, not morrowind doesn't exactly have a comprehensive design document, and even if it does, Hard Numeric Mechanics like this have to be replicated exactly. Except for pickpock...

OpenMW's 1.0 goal is to replicate vanilla gameplay as exactly as is possible, so we should at least get this right. A hotpatch might put off getting it right until later.

In vanilla morrowind (with a mod to change the one setting): I set fSleepRandMod to 1 and it seems to make it so that all sleep times above a certain value (right around 4, sorry, forgot the exact one) always result in an encounter, and ones below it do not.
