Appears to work correctly for me, using the OSG branch 0.36, on Windows 8.1.
New starts a new game, with no errors, though little to see or do - which I presume is the intention.

Copyright law is very clear here: the rights belong to the author of the work not to the software/tools used to create the content. Bethesda doesn't have a leg to stand on in that regard.
